Common Consequences of DUI

The exact penalties you face will likely depend on the number of previous convictions you have had, as well as the circumstances of the alleged incident. Penalties also increase if you are charged with a high blood alcohol content (BAC).

The penalties you could face include:

  • First time: If this is your first DUI offense, it is a misdemeanor offense and you could face six-months’ probation, a $300 fine, and required treatment.
  • Second offense: If you have had one previous conviction, your second conviction could carry a misdemeanor charge, 12-month license suspension, up to six months in jail, up to $2,500 in fines, and the installation of an ignition interlock device on your vehicle.
  • Three or more offenses: If you have been convicted at least twice before, you could face a second-degree misdemeanor charge, a year-long license suspension, up to two years in prison, up to $5,000 in fines, and the installation of an ignition interlock device on your vehicle.
