Understanding the Estate Administration Process in Pennsylvania

Helping Executors & Families Navigate Probate with Confidence

Estate administration can feel complex, especially during a time of grief. Whether you're an executor, administrator, or family member unsure of the next steps, our team at The Law Offices of Anthony Urban, P.C. is here to guide you with clarity and compassion.

With over 60 years of estate and probate experience in Schuylkill County, Northumberland County, and surrounding Pennsylvania communities, we help streamline the legal process and protect your interests at every step.

What Is Estate Administration?

Estate administration is the legal process of settling a deceased person’s financial affairs: paying debts, filing taxes, and distributing assets to heirs. If the decedent had a valid will, the executor named in the will handles these duties. If no will exists, the court appoints an administrator to manage the estate under Pennsylvania intestacy laws.

A Step-by-Step Guide to Estate Administration in PA

We provide full-service support through each phase of the estate administration process:

 Step 1: Probate the Will

The first step is filing the will with the Register of Wills in the appropriate county (Schuylkill or Northumberland). Once accepted, the executor is officially appointed to represent the estate. When there is no will, an administrator is appointed instead, serving the same role as an executor.

Step 2: Notify Heirs and Creditors

The law requires public notice of the estate and written notification to known creditors and beneficiaries. Our team ensures all deadlines and legal requirements are properly met. Pennsylvania Department of Human Services and Department of Revenue are also typically notified of the decedent’s estate.

 Step 3: Inventory the Estate

We work with the executor to identify, collect, and value all assets, including:

  • Bank accounts and investment accounts, including retirement, IRAs, annuities, and even life insurance policies
  • Real estate
  • Vehicles
  • Personal property
  • Business interests

Step 4: Pay Debts, Expenses, and Taxes

Outstanding obligations are settled, including:

  • Final medical bills and funeral costs
  • Creditor claims
  • Pennsylvania inheritance tax
  • Final personal income taxes

We prepare and file required returns, such as Form REV-1500 with supporting schedules, and ensure compliance with state timelines to avoid penalties.

 Step 5: Distribute Assets

Once all debts and taxes are paid, remaining assets are distributed to heirs per the will or, if no will exists, through intestate succession.

FAQs About Pennsylvania Estate Administration

What if there is no will?
The probate court will appoint an administrator, and assets will be distributed according to Pennsylvania’s intestacy laws, beginning with the spouse and children.

Can the executor be held personally liable?
Yes - executors can be held financially responsible for mistakes of malfeasance. Legal support helps reduce this risk significantly.

Do I need an attorney to handle the estate?
While not legally required, an estate attorney can protect you from costly errors, ensure compliance with state law, and handle unexpected challenges like will contests or unclear asset ownership.
